Change of employer
Change of employer - (art. 100 of Law 6.815/80 and art. 111 of Decree 86.715/81)
An alien admitted to the National Territory for service in a particular company, intending to transfer to another, must request in advance authorization from the Ministry of Justice, which will hear the Ministry of Labour and Employment and decide the merits of the claim.

In the case of transfers between companies of the same economic group or conglomerate, the alien must communicate the change to the Ministry of Labour and Employment, within thirty (30) days immediately after that as provided by law.

The request must be filed with the Office of the Federal Police Department nearest person's residence or the General Protocol of the Ministry of Justice.

Requirements to stakeholders request for change of employer:
a. Be temporary visa holder item V with employment.

Documentation required for processing the application:
• Application form with duly signed;
• Certified copy of identity card for temporary foreign V (work);
• Copy of Work Contract that generated the granting of a visa;
• Consent expressed by the company or entity which was initially hired as the change of employer;
• Certified copy, clear and complete passport (including the blank sheets) or equivalent identification document;
• Contract of Work with the new company, stating that the employer takes responsibility to maintain and provide the return of the contractor;
• Certified copy of the Articles of Incorporation or Bylaws of the new company;
• Certified copy of complete and working papers;
• Rationale formulated by the new company on the need for change;
• Curriculum vitae of the person concerned.
•Other documents may be required when deemed necessary.

All documents issued abroad must be legalized at the Brazilian consular authorities in the country of dispatch and translated by an official translator in Brazil, sworn or duly registered with the Board of Trade.

Where to find the required forms:
The form is available from the Ministry of Justice website www.mj.gov.br / foreigners, on the "Foreigners' Entry and Permanence» Extension »Extension of temporary visa I (cultural trip or mission studies), or along one of the units of the Federal Police Department.

Rate value and place of payment: Free service.

Channel service request user
The request for change of employer, duly instructed in the application form and other documents should be submitted before the department's Federal Police Department nearest person's residence or by the General Protocol of the Ministry of Justice, when it will be registered as Administrative Proceedings and receive protocol number for tracking.

Requests for change of employer can be ordered with a request for an extension of stay in Brazil, where appropriate.

It is essential that every foreigner with the administrative process of stay in the country pending communicate to one unit of the Federal Police Department any change of address.

Hours:
The hours of operation of the General Protocol of the Ministry of Justice are Monday through Friday, from 08h to 18h.

In other cases, the hours of operation varies with the internal organization of the units of the Federal Police Department.

Deadline for completion of the demand (analysis and decision of the application):
On average six (06) months, unless verified need for supplementary investigation of the administrative process, in which case the letter will be forwarded to interested requirement, granting him a period of thirty (30) days to submit the missing documents.

The monitoring of applications for extension of stay can be done through the Customer Service Center of the National Secretariat of Justice, located on the Esplanade of Ministries, Ministry of Justice, Annex II - Ground Floor, Brasilia / DF, e-mail: @ foreign mj.gov.br, or through the Internet site: www.mj.gov.br / foreigners, on the "Consultation processes".

Decision of Request:
Deferral:
If the extension request is GRANTED, within ninety (90) days from the date of publication of the grant in the Official Gazette, the applicant must attend the unity of the Federal Police Department nearest your residence to update the record .

Rejection and Reconsideration:
Rejected the request for extension, the applicant shall have fifteen (15) days extendable, counted from the date of publication of the decision in the Official Gazette, to request reconsideration of the decision, as provided in the SNJ Ordinance No. 03/2009.

The request for reconsideration must be supported by facts and documents that could entail the modification of decision filed by the Unit and the Department of Federal Police closest person's residence or the Service Center of the National Secretariat of Justice.

In addition to the documents that modify the decision of denial, the request must be accompanied by proof of payment of the fee in the amount of R $ 75.07 (seventy five dollars and seven cents), which must be paid by the Union Collection Guide - GRU.
