1st Panel grants the request for the extradition of Uruguay investigated for theft



The First Chamber of the Supreme Court (STF) granted unanimously request for extradition (Ext 1315) formulated by the government of Uruguay against Airton Silva Duran, a citizen of that country, investigated the alleged commission of the offense of theft detailed. The decision of the Group took place at a meeting held on the afternoon of Tuesday (10).



"The request is properly the assumptions of Law 6.815/80 - Foreigners Statute", understood the rapporteur of the Extradition Minister Dias Toffoli. He said the criminal acts imputed to extraditing correspond, in Brazil, the crime of theft detailed, article 157, paragraph 2, paragraph I, of the Brazilian Penal Code, "thus satisfying the requirement of dual criminality under Article 77 , II, of Law 6.815/80. "



The Rapporteur noted that there was no prescription having as parameter the legislation of the two countries. He added that the application was accompanied by the necessary documents, containing, including details regarding the specific indication about the location, the date, the nature and circumstances of the criminal acts, "in full compliance" with Article 11 of the Bilateral Treaty between Brazil and Uruguay and Article 80 of the Statute of Alien. Thus, the minister Dias Toffoli voted to grant the extradition, having been accompanied by unanimous vote.
